Proposed Legislation Addresses FAIR BIDDING PRACTICES for Painting Contractors

AB 1736 – Assemblymember Tom Daly
Timely Notification of Accepted/Rejected Bids
Supported by PDCC

PDCC Members … Thanks for Your Help!  Many of you completed the short online survey we sent out a few weeks ago.  Your efforts Made a Difference!  Our lobbyist was able to provide the requested information to the Senate Government & Finance Committee, and we’re happy to report that AB-1736 has passed out of that committee.

AB-1736 will mandate that the local agencies create and maintain a policy for notifying a successful bidder of the selection and approval of the bid within a reasonable time frame, and that they shall also notify unsuccessful bidders of the rejection/disapproval of their bid within a reasonable time frame. “Bidders” include general contractors and subcontractors.

New Law Equips Subcontractors to Enforce Prompt Payment!

AB 1223 – Assemblymember Anna Caballero
Timely Construction Contract Payments
Supported by PDCC

This law mandates that within 10 days of making a construction contract payment, a state agency that maintains an Internet Web site shall post on its Website the following:

  • Project for which the payment was made;
  • Name of the construction contractor or company paid;
  • Date payment was made or the date the state agency transmitted instructions to the Controller or other payer to make the payment;
  • Payment application number or other identifying information; and
  • Amount of the payment.

The law will exempt from these provisions construction contracts valued below $25,000 and specified progress payments published in the California State Contracts Register under existing law.
